de Informaci\u00f3n (SII)<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ed063e6 elementor-widget elementor-widget-text-editor\" data-id=\"ed063e6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>El Consejo de Administraci\u00f3n de CENTRO CULTURAL PINEDA S.A como responsable de la implementaci\u00f3n del <strong>Sistema Interno de Informaci\u00f3n (SII)<\/strong>, ha aprobado la creaci\u00f3n de un canal espec\u00edfico para que las personas que trabajen o hayan trabajado para la sociedad y\/o para el centro educativo, y que hayan obtenido informaci\u00f3n sobre infracciones en el contexto laboral o educativo (incluyendo voluntarios, becarios, trabajadores en periodos de formaci\u00f3n) puedan informar de determinados hechos, con garant\u00eda de que se les dispensar\u00e1 la protecci\u00f3n prevista legalmente.<\/p>\n<p><strong>Se puede utilizar<\/strong> el canal interno de informacio\u0301n <strong>para informar de conductas indebidas graves o de presunta corrupcio\u0301n<\/strong>, que puedan ser constitutivas de infracciones penales o administrativas graves o muy graves relacionadas con las actividades de CENTRO CULTURAL PINEDA S.A. as\u00ed como de los Colegios Pineda y Avantis que el informante haya observado o sobre las que haya recibido informacio\u0301n en el curso de su trabajo para el COLEGIO o de su relacio\u0301n profesional con los COLEGIOS, descritas en el arti\u0301culo 2 de la Ley 2\/2023. Si denuncia hechos que exceden de este \u00e1mbito, se le har\u00e1 saber por el Responsable del Sistema.<\/p>\n<p>CENTRO CULTURAL PINEDA S.A garantiza, mediante la actuacio\u0301n independiente del Responsable del Sistema, la exhaustividad, integridad y confidencialidad de la informacio\u0301n, la prohibicio\u0301n del acceso no autorizado, el almacenamiento duradero de la informacio\u0301n, la proteccio\u0301n integral del informante y el respeto a la buena fe.<\/p>\n<p><strong>Los datos que facilite como informante son confidenciales<\/strong>, y ser\u00e1n tratados como contempla la legislaci\u00f3n vigente.<\/p>\n<p>Como infomante que presenta una comunicaci\u00f3n conforme a lo previsto en la ley, se le garantiza por la entidad que no recibir\u00e1 ning\u00fan tipo de represalia, ni trato desfavorable. Estas medidas de protecci\u00f3n tambi\u00e9n ser\u00e1n extensivas a otras personas f\u00edsicas y jur\u00eddicas vinculadas con el informante (compa\u00f1eros de trabajo, familiares, sociedades con las que ostente una participaci\u00f3n significativa).<\/p>\n<p>Si la persona que informa de estas infracciones, a su vez, hubiera participado en la comisio\u0301n de la infraccio\u0301n administrativa objeto de la informacio\u0301n, se tomar\u00e1 en consideraci\u00f3n esta circunstancia para atenuar, y en determinados casos eximir, de la responsabilidad administrativa que le correspondiera.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1059f9e elementor-widget elementor-widget-text-editor\" data-id=\"1059f9e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Se pueden comunicar estos hechos por las siguientes v\u00edas:<\/p>\n<p><strong>&#8211; Por escrito<\/strong>, bien dirigiendo su comunicaci\u00f3n por v\u00eda postal a la siguiente direcci\u00f3n <span style=\"font-size: 17px;\">C\/ Joncs, 1 de 08902-Hospitalet de Llobregat<\/span> o mediante el formulario que encontrar\u00e1 m\u00e1s abajo en esta p\u00e1gina web.<\/p>\n<p><strong>&#8211; Verbalmente<\/strong>, de forma telef\u00f3nica en el tel\u00e9fono <span style=\"font-size: 17px; color: var( --e-global-color-text );\">93.263.79.90<\/span><\/p>\n<p>&#8211; Solicitando por alguno de los medios anteriores una <strong>reuni\u00f3n presencial<\/strong> con el Responsable del Sistema de Informaci\u00f3n.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6e004d0 elementor-widget-tablet_extra__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"6e004d0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En todo caso tiene derecho a realizar la comunicaci\u00f3n de forma an\u00f3nima si as\u00ed lo desea. Si lo comunica de forma no an\u00f3nima, su identidad no ser\u00e1 revelada a terceras personas.<\/p>\n<p>Tambi\u00e9n puede comunicar estos hechos directamente, si lo prefiere, ante la autoridad administrativa competente, o ante la autoridad judicial, o ante el Ministerio Fiscal o ante la polic\u00eda competente.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f5c54d7 elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"f5c54d7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Si utiliza este canal de comunicaci\u00f3n tiene que saber que recibir\u00e1 en los 7 d\u00edas siguientes un justificante de recepci\u00f3n de su comunicaci\u00f3n, y se abre un procedimiento interno que tiene estas fases, y que inicialmente no ser\u00e1 superior a 3 meses:<\/p>\n<ol>\n<li><strong>ADMISI\u00d3N<\/strong>. Hay que comprobar si ha comunicado hechos que est\u00e1n dentro del a\u0301mbito objetivo de aplicacio\u0301n definido en el arti\u0301culo 2 de la Ley 2\/2023, y si el informante se encuentra en el a\u0301mbito subjetivo de aplicacio\u0301n definido en el arti\u0301culo 3 apartados 1 y 2 de dicha Ley. Se le comunicar\u00e1 al informante, salvo que haya renunciado a ello, si se admite o inadmite.<\/li>\n<\/ol>\n<ol start=\"2\">\n<li><strong>INSTRUCCI\u00d3N<\/strong>. Hay que comprobar si los hechos comunicados son veros\u00edmiles, garantizando los derechos del afectado y del denunciante.<\/li>\n<\/ol>\n<ol start=\"3\">\n<li><strong>FINALIZACI\u00d3N<\/strong>. Concluidas las actuaciones de investigaci\u00f3n, el Responsable del Sistema emite un informe que notifica al informante (salvo que haya renunciado a ello) y a la persona afectada, en el que seg\u00fan su contenido se decidir\u00e1 si se archiva el expediente, se remite al Fiscal, o se traslada a las autoridades o departamentos competentes.<\/li>\n<\/ol>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section
